After a long legal battle, Kelly Rutherford has finally won custody of her children.
The 46-year-old Gossip Girl actress now has sole custody of her eight-year-old son Hermes and six-year-old daughter Helena after a judge ruled that they must be brought home from Monaco. The children have been living with their father Daniel Giersch for three years, but now they’ll reside with their mother in Los Angeles, after this ruling.

Previously, even when Rutherford went to Europe to see her children Giersch wouldn’t let her, but now she’s in control and will keep their passports.
Next, there will be a hearing on June 15th in which both parents and kids (or Giersch’s representatives) will be present. Rutherford’s lawyer Wendy Murphy said:
“We are ecstatic, and hopeful that Monaco will respect the California court’s ruling and send the children home. It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country. If the citizenship shoe were on the other foot and these children were citizens of Monaco, I have no doubt the United States would respect their right to reside in Monaco. Monaco officials know that sending the children back to America is the right thing to do. I’m looking forward to the happy reunion of the children not only with their mother, but also with their country!”
Hopefully Kelly and Daniel can come up with some amicable plan to raise their two kids going forward.
