Bill Cosby Retrial: Lawyers Move to Exclude 19 "Prejudicial" Accusers From Testifying

Just a few weeks ago, Bill Cosby went on stage and joked about his rape accusations. People actually went to see him, if you can imagine.


The disgraced comedian’s last trial ended in a deadlock, but he’s up for retrial over the later this year for the 2004 sexual assault of Andrea Constand.


And his lawyers are righting to exclude 19 different women from testifying.



Bill Cosby has more than 60 accusers who alleged that he sexually assaulted them.


That is a tremendous number of women who’ve come forward with stories of some of the worst moments of their lives.


Of course, convicted sex monster Dr. Larry Nassar has over 140 accusers.


And Director James Toback has over 300 accusers, including Selma Blair and Rachel McAdams.


But this isn’t the world’s worst contest, and for anyone accused of any crime to stand accused by so many is rare. The idea that a single person could do so much harm to so many people is horrifying.



For many of Bill Cosby’s accusers, there are no options for criminal prosecution because of statutory rape laws that allow countless sexual predators to evade justice.


Traumatized victims do not always come forward immediately, especially in a sex-negative society that shames survivors and especially when the sex monster who preyed upon them is wealthy, beloved, or a celebrity.


Or all three.


Andrea Constand, however, is able to take Bill Cosby to trial because she did come forward in 2004. We cannot image how much bravery she needed.


Though Cosby’s trial last year ended in a deadlock, one can’t help but wonder if jurors might view him differently in the #MeToo era, when people are conscious of how many sex monsters have been prowling the entertainment industry for decades.



When asked about how he thinks that his trial might be impacted by the (slowly) changing culture, Billy Cosby made this face:


We don’t yet know whether Cosby will face his #TimesUp moment. Like we said, he went on stage just a few weeks ago in an impromptu performance.


But, though he makes the human equivalent of the shrugging emoticon … ¯\_(ツ)_/¯ … when asked, his attorneys are taking a more proactive approach when it comes to determining what the jurors will decide.


Cosby’s team is attempting to exclude 19 of his accusers from testifying at his trial, arguing that it would be prejudicial.


Interestingly, they’re claiming that hearing 19 women say that Bill Cosby sexually assaulted them won’t be helpful in letting jurors decide if it’s likely that he sexually assaulted a woman.


In papers filed in Montgomery County Court, Cosby’s team argues:



“While the prospect of trotting out 19 other accusers makes for a splashy headline, it does nothing to advance the goal of fairly deciding Bill Cosby’s guilt or innocence.”


That’s quite the claim.


“Admitting evidence of even just one of these uncharged and unproven accusations would be highly prejudicial.”


For the record, usually when something is excluded for being prejudicial, it is because it’s either irrelevant or, well, subject to actual prejudices, without yielding sufficient probative value for the judge to consider it “worth the risk.”


For example, issues or race or religion or sexuality — of the victim or the defendant — might impact bigoted jurors who weren’t excluded during the Voir Dire process.



We’re no legal experts by any means.


Since these are accusations that Bill Cosby did the same crime for which he’s on trial, however, it sounds pertinent to our unschooled ears.


Similarly, if a man is accused of robbing a bank, hearing testimony accusing him of 19 other bank robberies might be good to know, right?


Seems like that might be something that jurors would want before they put it to a vote, as it ties him to some sort of pattern. Who knows.


It’s up to the individual jurors and their conscience to process all of the evidence and determine who is likely to be telling the truth and who is likely to be lying.



But there’s no telling what a judge might determine, especially when an expensive defense team and national attention are involved.


We won’t know the ruling until March, and the retrial date is currently set at April 2nd.


If the judge allows the testimony from these 19 accusers, Cosby’s team has indicated that they will seek a postponement.

James Franco Accusers Open Up: He"s Not as Bad as Harvey Weinstein

On Tuesday, the 2018 Academy Award nominations were accounced, and the list of honorees contained several surprises.


Perhaps the most noteworthy snub was that of James Franco.



Following wins at the Golden Globes and Critics Choice Awards, Franco was considered the frontrunner in the Best Actor category, and many stunned when he didn’t even receive a nomination.


Due to the secret nature of the nomination process, we may never know exactly why he didn’t receive more votes from his peers.


It’s worth noting that the Academy is generally less accepting of comedies than other award-granting bodies, and controversy over filmmaker Tommy Wiseau whom Franco portrays in The Disaster Artist may have also been a factor.


But the consensus in Hollywood is that it was the sexual harassment allegations against Franco that caused Academy voters to balk at honoring the actor with a nomination.


As you may have heard, when Franco won the Golden Globe for Best Actor, actress Ally Sheedy posted several tweets suggesting that he behaved inappropriately while directing her in an Off-Broadway play.



Shortly thereafter, several other women came forward to accuse Franco, eventually bringing the total number to five.


Yesterday, two of those women appeared on Good Morning America to discuss their experiences with Franco, 


Sarah Tither-Kaplan was a student in Franco’s “Sex Scenes” actng class 


Violet Paley is a former girlfriend of Franco’s who says she felt coerced into performing oral sex on her first date with the actor.


Both women opened up about their individual experiences in a remarkably candid interview:


“James abused his power by exploiting the non-celebrity women that he worked with under the guise of giving them opportunities,” Tither-Kaplan said.



She added that she felt pressured to perform nude while appearing in a film directed by Franco:


“There were a lot of scenes that were added after we were given the original scripts that I felt I wished I had more time to consider them or understand the artistic value of them…sex scenes, nude scenes, yes, a lot of the time they seemed gratuitous and exploitative.”


But while she maitained that Franco abused his power over young women, she also concedesd that his misconduct is not nearly as egregious as that of disgraced studio head Harvey Weinstein.


“He’s absolutely not a Harvey Weinstein,” Tither-Kaplan said.


“He is not an unfeeling monster who has no sense of reality. He created exploitative environments for non-celebrity women on his sets and I also think James is a talented and valuable person.”



Tither-Kaplan elaborated:


“It is a pyramid and at the top is rape and sexual violence and at the bottom are the other abuses of power that when they continue to happen over and over build and build and build and create a culture that allows the most heinous examples of sexual violence and misogny and discrimination to happen and if we allow any of them, we’re allowing all of them.”


For her part, Paley says her story is “complicated” by the fact that she later entered a relationship with Franco, but maintains that she was pressured into performing a sex act with which she didn’t feel comfortable during one of their first interactions.


“I am regretful. I was young, he was a celebrity that I looked up to,” Paley says.


Both women agreed that Franco is “not unforgivable,” and made a simple request to the 39-year-old during their time on air:


“Please just apologize,” Paley said, addressing Franco.

Pamela Anderson Said WHAT About Harvey Weinstein Accusers?!?

Pamela Anderson doesn"t have much sympathy for the women who have accused Harvey Weinstein of sexual harassment or assault.


Several weeks ago, countless alleged victims came out and claimed the movie producer made unwanted passes at them or forced them to take part in unwanted sex acts.


More than one has even claimed she was raped by Weinstein.



Thanks to these courageous women, numerous others have come out and leveled charges of similar mistreatment against such stars as Louis CK, Charlie Rose and Matt Lauer.


But Anderson doesn"t see Weinstein"s accusers as brave or courageous.


She sees them as… stupid?!?


"It was common knowledge that certain producers or certain people in Hollywood or people to avoid, privately," Anderson told Megyn Kelly on Friday morning, adding:


"You know what you"re getting into if you"re going into a hotel room alone."


Did they, though?


Did these young women, many of whom were just starting out in Hollywood, really know Weinstein was such a monster?


And what is Anderson"s general point here anyway? Is she really placing even an ounce of blame on the victims of sexual assault?



Saying you should have known better after someone gets raped is never a good look.


The ex-Baywatch star went on to say women need the "ability of self-protection."


Meaning what, exactly?


"There are a lot of self-protection courses. There is even a well known story of suffragettes learning martial arts."


Asked about her comments by TMZ, Anderson insists she was "not victim blaming."


Weinstein is absolutely "a sexist pig and a bully," she added and the women did not deserve what he reportedly did to them.



Still, she says she won"t be "coerced into apology" and she stands by her original comments to Kelly.
